One the first questions I ask when a potential San Diego DUI client calls for a free telephone consultation is “Do you have the pink sheet of paper that they gave you when you were arrested?” What detention / arrest date shows on the upper left side. This is your Temporary Driver License and you have 10 days from the arrest to REQUEST A HEARING TO SHOW THAT THE SUSPENSION OR REVOCATION IS NOT JUSTIFIED. “Why is that important?” is what we hear a lot at San Diego Defenders. And my answer is really two-fold. When you hire us, we charge a flat fee, no surprises. San Diego Defenders DUI lawyers make all your misdemeanor court appearances for you – that means you don’t have to go to court unless we tell you that you do! It also means that we will set your DMV hearing for you and conduct that hearing for you as well. We are a one-stop shop.

The Pink Sheet which says at the top “AGE 21 AND OLDER- PAGE 3 ADMINISTRATIVE PER SE SUSPENSION/REVOCATION ORDER AND TEMPORARY DRIVER LICENSE” is only good for 30 days if your lawyer does not ask for a hearing. If the hearing date occurs after the 30 days allowed, your temporary driver license is automatically extended. And usually that means until after the outcome of the hearing is formally announced in writing and sometimes a week after that even if the hearing does not go your way. But wait, there is more! The DMV is required to send “discovery” which is a DUI lawyer way of saying your arrest reports, BAC official results and sometimes the video, if there is any available. San Diego DUI lawyers Dan Smith and Jon Pettis, that is us, will tell you that having the reports allows us to formulate a defense strategy in your DUI case before your first court date. Knowing your BAC gives us a good idea what we want you to do to be proactive in your case and impress the DA prosecutor and more importantly, the judge.
Many times, we will ask you who the arresting agency was. That is is the bottom left hand corner of the Pink Sheet. If it is the CHP, we will have a good idea as to how the reports will be prepared and that there is usually MVARS video for at least part of the arrest. If it is a border DUI, then it may not include a recording of your FST’s of Field Sobriety Tests which are all good indicators of how we will approach the defense of your DUI case. More and more, DUI’s are having an affect on a person’s concern “Can I get a job after a DUI?” “is it better to get a Wet Reckless?” There are so many questions and concerns. San Diego Defenders has affordable fees and payment plans so that you have the best defense in your DUI case and it includes the DMV hearing which will help give us more information before your court appearances whether it is at 220 W. Broadway, San Diego, CA or 500 3rd Ave, Chula Vista, CA or 250 E. Main Street, El Cajon, CA or the Vista Court house on S. Melrose Ave, Vista CA.
