What is the Three Strikes (3-strikes) Law?

The origin of the term is clear to most people, even if they do not follow baseball. Three strikes and you are out! The Three Strikes law was enacted in California to require that state courts hand down mandatory and extended prison time to an individual found guilty for a third time of a serious offense.

The Three Strikes Law means that if you are convicted of a crime and the judge considers it a serious offense, it will be considered as a strike. Accumulate three strikes and you will face mandatory prison time! The sentence will also be made harsher to account for any leniency you may have received previously.

Can I get a strike for a DUI?

The short answer is: absolutely yes! If you are convicted of a felony DUI, it will most likely be considered a strike. This is why it is so important to convince the prosecutor and the court to reduce the charge to a wobbler or even a misdemeanor. Under California DUI laws a person charged with a felony and has two or three strikes will face several years in State Prison.
