What happens to bail once my case is over? By Daniel Smith

If you paid a bail bondsmen to bail you out any money you will not receive a refund of any kind.

If you or someone or a friend paid the entire bail, once the case is over the court exonerates the bail. Exoneration takes place in several ways:

  1. The case is concluded;
    • You plead guilty, were found guilty, were found innocent or entered a plea deal.
  2. The Court orders you into Penal Code 1000 (drug diversion program);
  3. The Court declares you incompetent to stand trial;
  4. You are committed into custody following an adverse verdict.

If you posted cash bail and suffer a conviction that includes a fine and/or restitution your bail will be applied towards those penalties.
