California Open Container Laws (Vehicle Code Sections 23221 to 23229) By Daniel Smith

California Open Container Laws (Vehicle Code Sections 23221 to 23229) make it illegal to have an opened alcoholic beverage in the passenger compartment of a motor vehicle. More specifically, the laws prohibit:

  • drinking in a car;
  • possession of an open container in a car;
  • storing open containers in a car, and
  • storing open containers in a trunk.

It is common for a violation of Vehicle Code Sections 23221 to 23229 to result in an infraction however if you have a minor (under the age of 21) in the car or you are driving, suspected of recently driving or about to begin driving you may be charged with a more serious offense.
