California Penal Code 647 prohibits an individual from being drunk in public. You are drunk in public if:
1. your level of intoxication makes you unable to exercise care for your safety or for the safety of others, or;
2. your level of intoxication interferes with, obstructs, or prevents others from using streets, sidewalks, or other “public ways”.
A charge of being drunk in public can be serious as it will represent a misdemeanor on your record, possible jail times and fines. If you are under the age of 21 you may also lose your drivers license even if you were nowhere near a car. A rigorous defense should handle any drunk in public case so that it does not go on your record and if under 21 you do not lose your license.
